The following is the NYSAR Legal Hotline disclaimer:

  • The NYSAR Legal Hotline is available only to members and only for informational purposes, not the provision of legal advice. It is designed to provide general information about recurring real estate topics of legal interest to members and not individualized or fact specific responses. Questions received enable the association to track issues of concern to its members and to address them through legislative or regulatory responses, educational programs, or other publications or services. For example, the NYSAR Members-only website contains frequently asked Legal Hotline Questions and Answers. 

  • The Legal Hotline is not intended to and does not create an attorney-client relationship, nor should any such relationship be implied. The Legal Hotline is not a substitute for competent representation by counsel engaged by a member regarding issues, transactions or litigation of concern. Members are encouraged to seek and engage their own legal counsel regarding any such matters. Even seemingly routine matters may involve unique circumstances and/or require detailed analysis. 

  • The Legal Hotline is a limited informational service and is not intended to provide fact specific, transactional or litigation advice. The caller is not and will not be represented as a result of the call by NYSAR or by NYSAR’s counsel, who answer Hotline calls as a NYSAR Member service. The phone call is a stand alone discussion and does not involve any review or preparation of documents or follow up activity. General information is supplied to members only, without any expectation of legal representation. Association counsel do not undertake formal conflicts of interest checks, but will refrain from any interaction involving an known conflict of interest. Phone calls are not confidential in nature as no attorney-client relationship is formed.

  • NYSAR reserves the right to limit the topics and duration of calls. NYSAR has no legal liability for the information provided by the Legal Hotline and recommends that if legal advice is sought, that members consult and retain competent legal counsel for appropriate legal representation.
