New York State Lead Rental Registry

In April, 2023, the Governor and State Legislature passed measures in the 2023-24 State Budget directing the Department of Health to develop a Lead Rental Registry Program. Draft Regulations necessary to implement this program were published on December 24, 2024. Final approval of these regulations is expected by November, 2025.

The New York State Lead Rental Registry Program, in accordance with New York State Public Health Law (PHL) § 1377, will apply to residential rental dwellings with 2 or more units built prior to 1980 located in certain zip codes within 25 identified “communities of concern” (excluding New York City). The Program will require landlords to certify such dwellings are free of lead paint hazards and submit inspection certification to their local health department. Remediation of lead-based paint hazards must be conducted in compliance with state regulations and municipal requirements.

The Lead Rental Registry Program applies to the following zip codes within communities of concern as identified by the Department of Health:

Regulations for the program, expected to be finalized by November 2025, will require:

  • Pre-1980 housing with two or more rental units to be inspected and documented as free of lead paint hazards before they can be issued a lead safety certification.
  • Landlords shall oversee prompt cleanup and lead safe repairs when hazards are identified. Compliance will be tracked, monitored, and enforced by the NYS Department of Health and Local Health Departments.

Available State Funding for Lead Remediation

The 2023-24 NY State Budget made available a recurring allocation of $20 million for the purposes of lead hazard remediation in communities of concern. The New York State Homes and Community Renewal Housing Trust Fund Corporation is awarding these funds to provide assistance to landlords to address lead hazards in rental properties. Interested landlords can apply for funding through their county health department.
